Why Estate Planning Is Really About Making Things Easier for the People You Love

Most people do not wake up excited to talk about estate planning.

 

In my experience as an Illinois estate planning attorney, clients are rarely motivated by documents themselves. They are usually motivated by wanting to make things easier for the people they love.

 

At JPR Law, LLC, many clients initially contact me because they know they “should” have a will or trust, but what they are really trying to accomplish is much more personal:

  • reducing stress for family members;
  • creating clarity during difficult times;
  • protecting children;
  • avoiding confusion and conflict;
  • making sure someone can step in if something unexpected happens.

One of the things I have learned helping Illinois families through both estate planning and estate administration is that organization and communication often matter just as much as the legal documents themselves.

 

Families tend to struggle most when:

  • nobody knows where things are;
  • beneficiary designations are outdated;
  • trustees or executors are unprepared;
  • expectations were never discussed;
  • or loved ones are left trying to guess what someone would have wanted.

A good estate plan can help create structure during a time when emotions are already high.

For some families, that may mean creating a revocable living trust. For others, it may simply mean making sure powers of attorney are in place and guardians have been nominated for children.

 

Estate planning is not one-size-fits-all. Every family is different.
